J&J Wins 11-Year Patent Suit against Medtronic, Boston Scientific Corp over Expandable Stent

Johnson & Johnson reported the company has won an 11-year patent suit against Medtronic Inc and Boston Scientific Corp over the Palmaz balloon expandable stent. A U.S. judge has awarded the company $ 1.2 billion dollars.

An 11-year patent battle between Johnson & Johnson (J&J) and Medtronic Inc. and Boston Scientific Corp has ended, with the award of $ 1.2 billion dollars by Judge Sue Robinson going to J&J.

The battle was over the patent for the Palmaz balloon expandable stent, which is no longer sold, and the patents have since expired. The companies were still arguing over details about the patents and the question of whether a new trial on damages should be held.

Medtronic was ordered to pay about $ 521 million dollars and Boston Scientific to pay about $ 703 million dollars, according to the judgment entered in the U.S. District Court in Wilmington, Delaware, J&J reported. The judge also awarded accrued interest eight-year-old post-trial damages of $ 324 million dollars against Boston Scientific and $ 271 million dollars against Medtronic.

A Boston Scientific spokesman said the company will appeal, while a Medtronic spokesman said the company may appeal the interest award.
